Fair terms, with your legal rights protected

This policy explains the ordinary process for rescheduling, cancellation, delivery problems and refunds. It does not remove a right or remedy under the CPA, ECTA or another applicable South African law. New Thought Academy will not apply a blanket “no refunds after knowledge is exchanged” rule where the law gives the customer a cancellation right or remedy.

1. Statutory cooling-off rights

Where ECTA section 44 applies and no statutory exception applies, a consumer may cancel an electronic transaction for services within seven days after the date the agreement was concluded, without reason or penalty, and a refund must be made within the period required by ECTA. ECTA recognises exceptions, including services that began with the consumer's consent before the seven-day period ended and certain categories of digital goods or publications.

If a transaction resulted from direct marketing as legally defined, separate CPA cooling-off rights may also apply. Any right that applies will be honoured even if the ordinary policy below is narrower.

Where the law allows immediate performance or delivery to affect a cooling-off right, the checkout must ask for the customer's clear, separate request to begin immediately. Immediate access must never be treated as permission to remove rights that cannot lawfully be waived.

2. Private Clarity Call — R500

Rescheduling: Give at least 24 hours' notice by email or WhatsApp. One reasonable move to another available time will normally be offered without an added service charge.

Cancellation before the call: You may ask to cancel in a recorded form. Any deduction must be a lawful and reasonable cancellation charge based on the notice given, the reserved time, the nature of the service and whether the appointment could reasonably be filled. A charge is not automatically the full R500.

Less than 24 hours or no-show: A reasonable cancellation charge may be deducted after the circumstances above are considered and will never exceed the R500 paid. If an emergency or exceptional event prevented notice, tell Khwezi so it can be considered fairly.

After delivery: Once the full call has been delivered, no ordinary change-of-mind refund is offered for the completed call, subject to any statutory right or remedy for a service that was not supplied with the quality or care the law requires.

If Khwezi cancels: You may accept a reasonable new time. If no suitable replacement can be agreed, the R500 will be refunded.

3. Practical Guide — R450

The guide is delivered digitally after payment is verified. Because cooling-off treatment can depend on the nature of the digital publication, how it is supplied and whether immediate delivery was requested, New Thought Academy does not use a blanket statement to override the law.

Where no statutory cooling-off right applies and the correct guide has already been supplied or accessed, an ordinary change-of-mind refund is not normally offered. This does not affect rights relating to a guide that is inaccessible, corrupt, materially incomplete or materially different from the description.

If there is a delivery problem, contact Khwezi. New Thought Academy will first try to restore access or supply a corrected copy. If that cannot reasonably be done, it will provide the refund or other remedy required by law. A verified duplicate payment will be refunded.

4. 3-Month Programme — R1,500 × 3

The programme is one three-month agreement paid in three monthly instalments, with a planned total of R4,500. It includes the scheduled private teaching, learning support and Practical Guide described before acceptance.

Before the programme starts: Tell Khwezi promptly if you no longer wish to continue. Any applicable cooling-off right will be honoured. If no cooling-off right applies, any deduction must still be fair and related to material or services already supplied and reasonable commitments already made for the reserved place.

After the programme starts: You may request cancellation by email, WhatsApp or another recorded method. Where CPA section 14 applies, you may cancel on 20 business days' notice. You remain responsible for amounts lawfully due up to the cancellation date, and a reasonable cancellation charge may apply where the CPA permits it.

A reasonable calculation may consider lessons and material already delivered, notice given, commitments reasonably made for the reserved place, any discount based on completing the full programme, the possibility of filling the place, and the value still undelivered. It will not automatically equal every unpaid instalment. New Thought Academy will credit any amount that remains the customer's property and will stop future collections beyond what is lawfully due.

Missed programme lesson: Give at least 24 hours' notice. A reasonable alternative will be offered subject to availability. Repeated late cancellations or no-shows may attract a reasonable charge or be treated as lost reserved time only to the extent fair and lawful in the circumstances.

If New Thought Academy cannot finish the programme: You may accept a reasonable revised schedule. If the remaining service cannot be delivered, the undelivered portion will be refunded after taking account of what was already supplied, without limiting another remedy available by law.

5. How to ask for help, cancellation or a refund

New Thought Academy may ask for enough information to verify the payment and prevent fraud. Approved refunds will be returned through the original payment route where reasonably possible. Paystack and the customer's bank may need additional processing time. A refund required by ECTA will be completed within ECTA's statutory period; all other refunds will be handled within the period required by applicable law.
